Partner Visa (Temporary)

Subclass 820

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily. This is visa category for onshore applicant. Applicants will first obtain this temporary visa Subclass 820, and a permanent visa Subclass 801 will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

Partner Visa (Permanent)

Subclass 801

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. It is usually only for people who currently hold a temporary Partner Visa (Subclass 820). Applicants will first obtain temporary visa (Subclass 820), and this permanent visa (Subclass 801) will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

Partner Visa (Provisional)

Subclass 309

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. This is visa category for offshore applicant. Getting this visa is the first step towards a permanent Partner visa (Subclass 100). Generally, applicants will first obtain this temporary visa (Subclass 309), and a permanent visa (Subclass 100) will be granted by meeting some conditions after 2 years.

  • If you are a married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are a de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

Partner Visa (Migrant)

Subclass 100

This visa allows your de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. It is usually only for people who currently hold a provisional Partner Visa (Subclass 309). Applicants will first obtain temporary visa (Subclass 309), and this permanent visa (Subclass 100) will be granted after 2 years.

  • If you are married applicant, you need to have a marriage certificate recognised by Australian laws, and maintain the marriage relationship during the visa application processing time.

  • If you are de facto applicant:

    • Both parties are over 18 years old; there is no family relationship between (such as adoption, common parents)

    • In the de facto relationship at least 12 months, and maintain the relationship during the visa application processing time.

Contributory Parent Visa

Subclass 143

This permanent visa lets a parent of a settled Australian citizen, Australian permanent resident of Australia or eligible New Zealand citizen move to Australia.

Applicant’s children must have lived legally in Australia for at least 2 years. Also, applicants need to meet the balance-of-family test: (1) at least half of your children and step-children are eligible children; (2) there are more eligible children living in Australian than in any other single country. Contributory Parent Visa (Temporary)

Subclass 173

This temporary visa lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen stay temporarily in Australia. With this visa, you can live in Australia for up to 2 years, work and study in Australia, and apply for a permanent Contributory Parent Visa (Subclass 143).

Applicant’s children must have lived legally in Australia for at least 2 years. Also, applicants need to meet the balance-of-family test: (1) at least half of your children and step-children are eligible children; (2) there are more eligible children living in Australian than in any other single country. If you are applying for permanent Contributory Parent Visa (Subclass 143), you can spread the cost of the permanent visa over a number of years by applying in 2 steps:

  1. first, apply for the temporary Contributory Parent (Temporary) (subclass 173) visa, then

  2. apply for the permanent Contributory Parent (subclass 143) visa

Parent Visa

Subclass 103

This permanent visa lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia. This visa requires applicants to be outside Australia when the visa is granted.

Sponsored Parent Visa (Temporary)

Subclass 870

This temporary visa lets a parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen visit Australia for up to 3 or 5 years. With this visa, you can re-apply for further Sponsored Parent (Temporary) visas to visit up to a maximum period of 10 years in Australia. This visa also does not require balance of family test or Assurance of Support. However, you cannot work in Australia while holding this visa.

Cost:

  • $5,000 for up to 3 years

  • $10,000 for up to 5 years

Eligibility:

  • Be the biological, legal parent, step-parent or parent in-law of the Parent Sponsor

  • Be aged over 18

  • Have a sponsor

  • Have met any previous visa obligations

 

Aged Parent Visa

Subclass 804

This permanent visa lets an aged parent of a settle Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia. With this visa, you can work and study in Australia, and get Medicare.

Cost: $6,415

Eligibility:

  • Not have a Temporary Sponsored Parent Visa (Subclass 870)

  • Have a sponsor

  • Be at least aged over 65

  • Meet the balance-of-family test

  • Have assurance of support

Adoption Visa

Subclass 102

This visa lets children adopted outside Australia live in Australia with their adoptive parent. With this visa, the child can work and study in Australia, get Medicare, and sponsor the relatives to come to Australia.

If the child has siblings who also want to apply for an Adoption visa, submit separate applications for each sibling. The child's dependent children can be included on their application when they apply or added to their application at any time before we decide the application.

Cost: $2,665

Eligibility:

  • Be adopted or in the process of being adopted

  • Have a sponsor

  • Be aged under 18

 

Child Visa

Subclass 101

This visa lets a child outside Australia move to Australia to live with their parents. This visa requires applicants to be outside Australia when the visa is granted.

The child must be a single dependent child of a parent who is an Australian citizen, eligible New Zealand citizen or holder of an Australian permanent visa. Also, the applicant either must be under 18 years, a full-time student aged over 18 and under 25 who are financially dependent on the parent, or over 18 who is unable to work due to disability.

Cost: $2,665

Eligibility:

  • Be dependent on their parent who is an Australian citizen, eligible New Zealand citizen or Australian permanent visa holder

  • Have a sponsor

  • Have no partner

  • Be aged under 18, a full-time student aged over 18 and under 25 , or aged over 18 with disability

 

Child Visa

Subclass 802

This visa allows a child to stay in Australia permanently and live with their parents. This visa requires applicants to be inside Australia when the visa is granted.

The child must be a single dependent child of a parent who is an Australian citizen, eligible New Zealand citizen or holder of an Australian permanent visa. Also, the applicant either must be under 18 years, a full-time student aged over 18 and under 25 who are financially dependent on the parent, or over 18 who is unable to work due to disability.
